What areas do you serve?

Our primary service area is the DMV (DC, Maryland, and Virginia), with a physical office located in Howard County, Maryland, midway between DC and Baltimore. While we primarily operate virtually, making geographic location less of a factor, we can also help clients in several other states. What is your pay structure?

I offer subscription plans designed to fit your budget and provide the support you need, when you need it. We also provide additional “projects” on a flat-fee basis. Learn more about my subscription plans on the Pricing page.

In-House Counsel

What is fractional in-house counsel?

Fractional in-house counsel provides businesses with the legal expertise of a full-time in-house lawyer on a part-time or as-needed basis, offering flexibility and cost-efficiency for growing companies.

How does in-house counsel differ from outside counsel?

In-house counsel offers dedicated legal support and deep knowledge of the company’s operations, enabling them to provide more proactive and strategic advice. In contrast, outside counsel, usually from big law firms, are hired on a project basis. These outside attorneys often come with higher costs and can lack the intimate understanding of the company’s inner workings that in-house counsel possesses.

When should I consider hiring fractional in-house counsel?

If your business is growing and facing increased legal complexities but doesn’t require a full-time legal team, fractional in-house counsel can provide the necessary support at a lower cost and with greater flexibility.

Employment Law

How can an employment lawyer help me understand and comply with employment laws and regulations?

An employment lawyer serves as your guide through the labyrinth of employment laws and regulations. We can clearly explain relevant federal, state, and local laws, ensuring you fully understand your obligations as an employer. Moreover, we can conduct comprehensive audits of your current policies and practices, identifying any areas of non-compliance or potential legal risks.

What are some common employment law issues businesses face, and how can an employment lawyer help prevent or resolve them?

Businesses often face a range of employment law issues, from discrimination and harassment claims to poor hiring and firing decisions, wage and hour disputes and wrongful termination lawsuits. An employment lawyer can help you proactively prevent these issues through training, policy development, and compliance audits.

When should I consult an employment lawyer regarding an employee issue or dispute?

The ideal time to consult an employment lawyer is before an issue or dispute emerges. Proactive, preventative strategies and early intervention can often prevent escalation and reduce legal risks. Whether an employee files a complaint, you’re considering termination, or you’ve received a request for leave or accommodation, seeking legal advice early can help you make informed decisions and take appropriate action, protecting both your business and your employees. In the unfortunate event that legal action commences, you can have confidence that the policies, procedures and practices you have in place, position you to defend your company.

Contracts

Why do I need a lawyer to draft or review my contracts?

A lawyer ensures that your contracts are legally sound, protect your interests, and comply with Maryland law, reducing the risk of future disputes.

Can you help with contract negotiations?

Yes, we represent your interests during negotiations to secure favorable terms and ensure the final contract aligns with your business goals.

How long does it take to draft a contract?

The time frame depends on the complexity of the contract. Simple agreements can often be drafted within a few days, while more complex contracts may take longer.

Hiring & Separation Practices

Do I need a lawyer to draft employment agreements?

It is highly advisable to engage competent legal counsel. While templates are great, a lawyer ensures that employment agreements are legally compliant, protect your business interests, and clearly define the terms of employment.

What should I consider when drafting a severance package?

Again, this is a great conversation for your attorney.  Many factors may be considered, most importantly, your organization’s risk tolerance and any legal obligations under the law. An experienced employment will help you create a fair and compliant package.

How can I avoid wrongful termination claims?

To avoid wrongful termination claims, follow proper procedures, document performance issues, and ensure that the termination complies with both state and federal laws.

Workplace Policies & Procedures

What type of training can you provide for my HR team?

We offer legal and HR training on various topics, including anti-discrimination, workplace harassment, employee relations, and compliance with employment laws, ensuring your team is well-prepared.

How can I ensure my DE&I program complies with legal requirements?

We help businesses design DE&I programs that not only promote inclusion but also comply with anti-discrimination laws and other legal standards specific to Maryland and federal employment law.

Are non-compete agreements enforceable in Maryland?

Non-compete agreements are enforceable in Maryland and beyond. We help businesses draft enforceable agreements that protect their interests.

Workplace Investigations

What types of workplace issues typically require an investigation?

Common issues include claims of executive misconduct, harassment, discrimination, employee misconduct, workplace bullying, whistleblower complaints, theft, fraud, and violations of company policies.

What are the consequences of not investigating employee misconduct?

Failing to promptly investigate claims of misconduct can lead to legal claims, employee dissatisfaction, low morale and damage to your company’s reputation, as well as potential financial penalties or lawsuits.

How can I ensure my investigation is impartial?

Hiring an external investigator or consulting with a lawyer ensures that your investigation is neutral and unbiased, minimizing the risk of claims that the process was unfair or incomplete.

About

Aisha Jorge Massengill

Small businesses are the backbone of this country, and I identify with the hustle and grit it takes to succeed. I believe every growing and thriving business should have access to qualified, experienced counsel without the obstacles that come with hiring a full-time legal team.

I grew up in the Bronx, at the intersection of the Sedgwick Housing Project and Andrews Avenue.

Decades later, I founded my law firm to provide fractional in-house counsel services to growing businesses.
